Facts

The majority of voters in Livermore in a municipal election voted to put a moratorium on residential permits until problems relating to school overcrowding, sewage pollution, and water rationing were solved. The ordinance put specific goals on the moratorium as stated on page 731 Rabin 4th. P filed suit to enjoin the enforcement of the ordinance and for declaratory relief. P got what it wanted, and the city appealed.
