Arkansas Midland Railway v. Canman

52 Ark. 517 (1890)

Canman (P) sued Railway (D) for personal injuries sustained by a train derailment. The trial resulted in a verdict and judgment for P and D appealed. The issue was the inconsistent special findings and the general verdict. The jury basically found negligence on the part of D but could not agree as to what particular neglect caused the derailment of the train.
