Ando v. Woodberry

8 N.Y.2d 165, 203 N.Y.S.2d 74, 168 N.E.2d 520 (1960)

Facts

Ando (P) and Nichols were involved in a traffic accident. Nichols was driving a car owned by Woodberry (D). P was injured in the collision. Nichols was given a traffic ticket as a result of the accident and pleaded guilty to both of the charges it contained. The only witnesses at the trial were Nichols and P. At trial, Nichols denied that he had done the things he had been cited for. P attempted to impeach his testimony by introducing the traffic ticket and Nichols' guilty plea, arguing that it constituted an admission under the hearsay rule. Over P's objection, the trial court excluded the evidence.
