Facts
P, a California corporation, seeks a declaratory judgment holding that its award to Boch of a prospective Honda dealership in Norwood, Massachusetts does not violate M.G.L. c. 93B. Clair (D) filed a counterclaim contending that the Honda dealership awarded to Boch violates M.G.L. c. 93B, §4(3)(1), which prohibits an arbitrary award of a new motor vehicle dealership in an existing franchisee's relevant market.
