Facts

Mary Ann, the wife of Peter died. The day after her death, Peter told his daughter, P to get a note which was among Mary's papers. Peter then drew up notes to his daughters, Leonora and Angelina, for one-half the balances due that Peter owed Mary on the note; those notes were sealed. Angelina sued Peter and P won a verdict on the note given.
