Facts

Thomas Alexander deeded property to his daughter, Sarah Andrews (D), on May 8, 1946. D did not record the deed until two months had passed (July 8, 1946). On May 14, 1946, Thomas deeded the same property to his son, Charles Alexander (P) and it was recorded on the same day. P paid $1,000 and agreed to care for him for the rest of his life and pay for the burial. P recorded his deed the same day. P lived on the land with his father until his father's death. P then sued D to quiet title. The court found for D. P appealed.
