Aguilar v. Texas

378 U.S. 108 (1964)

Facts

Police applied for a warrant to search Aguilar's (D) home based upon reliable information from a 'credible' person that they would find heroin, marijuana, barbiturates and other narcotics in the home. The warrant was issued, and when the trial was commenced, D's attorney objected to the introduction of the evidence obtained from that search warrant. The trial court overruled D, and he was convicted and appealed.
