Adams v. Baker

919 F.Supp. 1496 (Kansas, 1996)

Facts

Adams (P) was a fifteen-year-old female and freshman at Valley Center High School. D was the school district, the school board, and the superintendent and others. When P was in the eighth-grade P was a member of the Junior High School Wrestling team. P had a record of 5-3 of which three of the wins came by forfeit because some boys refused to compete against a girl in wrestling. P lost one match to another female wrestler. P sought to try out for the High School team and was prohibited from doing so because of her gender. P has the same coach this year as last year when she wrestled in Junior High. P sued under 42 U.S.C. 1983 and alleged that her right to equal protection was violated. P sought an injunction and money damages. The court held a hearing on December 5-6 and at the close of that hearing issued a TRO requiring either Ds allow P to try out or to discontinue the wrestling program for male students. The order has been extended three times by consent of the parties and is about to expire on February 2, 1996. This matter came up for a preliminary injunction.
