This was an action for the death of P's intestate caused by eating salt mullets bought from W. S. White, a retail grocery dealer. D was the packer of the fish, but left them on the wharf in the hot sun for 36 hours in September. Many people in the area who purchased the fish became sick. D was put on notice that people had become dangerously ill. D could have gotten the information to the retailer to stop the sales in time to warn P’s intestate. P alleged that there is a warranty which runs with the sale of food for human consumption that the article is fit for food and does not contain dangerous and deleterious substances, injurious or fatal to human life and health. The jury found for P, and D appealed.
