D was employed as a messenger by the Second National Bank. His duties included the transportation and delivery of money to branch banks. D and Hargis Trusty devised a plan to steal bank funds entrusted to D for delivery by making it appear that D had been robbed. While on a delivery run, D met Trusty at a rendezvous and turned over to him $16,000 in bank funds. Pruitt was shot in the arm and bullets were fired into the bank vehicle. Shortly thereafter Pruitt reported to police that he had been robbed by three masked men. D eventually admitted that his robbery report was not true and that Trusty had actually taken the money. D tried and convicted for stealing bank funds in contravention of 18 U.S.C. § 2113(b). D appealed.
