Buckley was hired by Pape (D) to represent both D and another woman. The two of them were indicted for transporting a woman in interstate commerce for the purpose of prostitution, debauchery, and other immoral purposes. At the first trial, Buckley appeared for the woman and obtained her release in his custody. At D's trial, Buckley was required to testify that D had hired him and had paid him to obtain the release of the woman. D was convicted and appealed.
