Nature Of The Case
This section contains the nature of the case and procedural background.
Facts
P, 67, was earning a modest but respectable living as a travel tour operator, when D, a wealthy widow with assets in excess of $40,000,000, began making demands and allegedly agreed to support him in luxurious fashion if he would devote all his time and attention to her. P gave up his business career where he earned no more than $8,900 a year and became the ever-present companion of D. P modified his wardrobe to suit her tastes. P accompanied her to lunch and dinner, escorted her to the theatre and parties, and traveled with her on her trips to Europe. Over 5 years P spent well over $300,000 for her “Boy toy's” personal needs. It ended and P sued D on the alleged promise D would pay all P’s costs and expenses for a sumptuous living for the rest of his life. P sought $1,500,000. D again moved for summary judgment after discovery in that the agreement is too vague and is void for lack of consideration.
