Facts
Ds were a black man and a white woman. They were charged by an indictment with fornication and adultery. They pled that they had been duly married. The trial court instructed the jury that Ds' marriage was a nullity. Ds were found guilty, and the trial court discharged a rule for a new trial. Ds appealed.
