Facts

Jose (H) married Donna (W) in 1983 in Washington State. A child was born in 1986, and the couple was divorced in 1990. The custody of the child was awarded to W with reasonable visitation granted to H. In 1991, W, consented to the adoption of the child by the Rays and they filed a petition for adoption in Oregon. H moved to dismiss that proceeding and that was denied. H then filed this writ of mandamus which was granted by the present court. The issue was whether the Oregon courts had jurisdiction over an adoption proceeding when the natural parents still reside in Washington.
