Facts

Vesey owned property. The Robinson's held a deed that was a forgery but purported to convey title to them. The Robinsons executed and delivered title to the Smiths and the Smiths, in turn, conveyed the land to Solberg (P). Vesey discovered the problems and sued P and won. P sued the Robinson's (D). In the deed from D to the Smiths, D covenanted and warranted the deed and seizin. The deed from the Smiths to P contained similar covenants. P got judgment and D appealed.
