Facts

Snyder (P) had open heart surgery (1984), and during it, he received several units of blood which was infected with AIDS. There was no direct test at the time to determine or screen blood for AIDS. P contracted AIDS. P sued on the basis that the blood could have been screened by surrogate testing for the antibody to hepatitis B. The jury found that D's negligence was a substantial factor in causing P to contract AIDS. The Appellate Division affirmed. D appealed.
