Nature Of The Case
This section contains the nature of the case and procedural background.
Facts
Sherer Gillett entered into a contract of conditional sale with H.C. Taylor for the sale of a display counter to be used by Taylor in his grocery store. Taylor agreed to pay $10 down and $10 per month until the full purchase price was paid with title to remain in Sherer until full payment had been made. Two days later, Taylor sold the counter to Long for $100. Long had no notice of the reservation of title under the contract of conditional sale and no notice of any rights of Sherer. Judgment was entered in favor of Long. The Appellate Court reversed.
