Facts
Farouki (D) borrowed money from Saadeh (P) and then defaulted on the loan. When the suit was filed to collect the unpaid funds, D was a citizen in Maryland under the status of a permanent resident immigrant but still a Jordanian citizen. P was a Greek citizen. While the lawsuit was underway, D became a citizen of the U.S. The district court found for P and D appealed on the merits in that there was no jurisdiction over him.
