Facts
Rojas (P) worked for Richardson (D) as a ranch hand. P was thrown from a horse and severely injured. P sued D for negligence and breach of contract. During closing argument, P was referred to as an illegal alien by defense counsel. P did not object. Judgment was given to D and P appealed.
