Facts
Antonio Caridis (D) stole a lottery ticket from Jim Pappas. Two days before the theft, the issuers of the ticket had declared it a winner. D took the cash for the ticket. D was charged by information with grand larceny. Lotteries were illegal in California. D demurred to the information; the facts as stated did not constitute grand larceny because D stole a piece of paper that was not worth $50. The charges were dismissed. The People (P) appealed.
