Saba (D) were five commissioners of Sarasota County, who withheld approval of Penthouse, Inc.'s (P) plan to build condos. P sued D under 42. U.S.C. § 1983 alleging that D acted arbitrarily, capriciously and in violation of County Zoning Ordinances. The trial court dismissed, and P appealed.
