Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

Nash (P) had a child fathered by Mulle (D). D was ordered to pay $200 per month in child support in 1984. In 1990, P filed for an increase in payments because of D's dramatically increased income. D was ordered to pay $3092.62 per month with $1,780.17 of that reserved for a college trust fund. The court of appeals reversed limiting the award to $1,310, which was 21 percent of the $6,250 top monthly income to which child support payments explicitly apply. The court also disallowed the college trust in that it extended the parental duty of support beyond the age of majority.
