Facts
Mason (P) alleged and proved that he loaned Miner the sum of $5,000. The loan was made on an oral agreement between the parties. Payment on the loan was made by Miner at the rate of $200 per month until the time of his death. P submitted a claim to the estate for the loan balance. Anderson (D) denied the claim and P sued. D moved for summary judgment under the Statute of Frauds. The trial court denied D's motion and granted summary judgment to P.
