Facts
Gross, the prosecuting witness, testified that Lear (D) came into the store and inquired about purchasing some shirts and shoes. Gross took some money out of the store safe and placed a bag of coins on the counter. D then suddenly without warning grabbed the bag from Gross’ hands while he was unwrapping the bag. D ran out the back door. D said nothing, displayed no arms and used no force to grab the bag from Gross. D was convicted of robbery and appealed.
