Facts
Kovacik (P) asked Reed (D) to superintend his jobs, and they would split the profits 50-50. P did not ask D to share any losses and D did not offer to do so. They worked together, and in August 1953, P told D that the venture did not make any money and that D contribute the amounts that P had advanced over and beyond the income he had received. D refused to pay. P sued D for an accounting and to recover the losses. P got the judgment for $4,340.
