Facts

Jones (P) and Green (D) purchased real property together. The deed conveyed the property to them 'as joint tenants with full right of survivorship and not as tenants in common.' P later filed this action, seeking to partition the property. D filed a motion for partial summary judgment, arguing that property conveyed to unmarried individuals as joint tenants with right of survivorship cannot be partitioned. The lower court rejected D's argument and denied the motion. D appeals.
