Facts

By mistake, P built a cistern on the land of D. When D learned of this he tried to stop it. The Municipal Court granted P relief even though D had no actual notice that P was constructing the improvement and D had, in fact, tried to stop the construction after he learned of it. P got judgment for $1,800 as equitable relief. D appealed.
