Nature Of The Case

This section contains the nature of the case and procedural background.

Facts

P is headquartered in Newbridge, Ireland. P designs manufactures and sells housewares, kitchenware, and silverware around the world under the mark NEWBRIDGE HOME. P's products are available for sale through its website and through retail outlets that feature products from Ireland. The mark has an International Registration No. 1068849. P sought protection of the mark in the United States. P disclaimed the word HOME apart from the mark as a whole in the application. The Examiner refused to register the mark as being primarily geographically descriptive when applied to applicant's goods under 15 U.S.C. § 1052(e)(2) (2012). The Board affirmed. P appealed.
