Nature Of The Case
This section contains the nature of the case and procedural background.
Facts
Testatrix had six bank accounts, four of which were Totten Trust accounts. In her will, she made all funds on deposit to her credit in any bank, or trust company or similar financial institution part of her testamentary distribution. The Appellate Division ruled that this was sufficient to show a clear and absolute intention on her part to revoke any prior trust bank accounts and to have the proceeds become part of her estate. This appeal resulted.
