Nature Of The Case
This section contains the nature of the case and procedural background.
Facts
Hughes (P) was severely burned when a stove manufactured by Magic Chef (D) exploded. The explosion was due to a third pilot light not being relit after the gas tank was refilled. The buildup of propane gas caused the explosion. P sued D in strict liability alleging the stove was unreasonably dangerous in several respects. D raised affirmative defenses of assumption of risk and misuse of product. D got the verdict, and the trial court overruled P's motion for new trial. P appealed.
