P was a passenger in Nickel's Volkswagen. Nickel found herself on the wrong side of the road, facing an oncoming car. Nickel turned to her right. She immediately found herself headed for a concrete bridge railing approximately ten feet away. Her speed was between 30 and 60 miles per hour. To avoid the bridge railing, Nickel turned sharply to the left, and the Volkswagen overturned. P sued D under products liability, alleging in part a failure to warn of the propensity of D’s car to roll over when executing a sharp turn. The case went to trial, and the court refused to instruct on a failure to warn. D got the verdict, and P appealed. The judgment was vacated, and the case remanded for additional rulings.
