Gore (P) brought an action against People's and M.S.B (Ds) for strict liability for the damages caused by their son's exposure to lead-based paint in D's dwelling. Ps moved from the apartment, and a department of health inspector inspected it for the presence of lead. The inspection revealed lead in the paint and notice was sent to the landlord to fix the problem. The apartment was inspected again, and it was determined that all hazards had been remedied. P claimed that their minor son suffered damages from the lead-based paint. The trial court granted Ds a motion for a directed verdict on the strict liability count. The jury came back with a verdict for D on the remaining counts and the trial court denied P's motion to set aside the verdict. The appeals court reversed. The Supreme Court of Connecticut granted certiorari.
