Facts
D ordered P to be placed in solitary confinement. P alleges that during their periodic checks, officials would “physically abuse” him. P sued Ds claiming that certain prison officials used excessive force against him in violation of the Eighth Amendment. The District Court dismissed the complaint, holding that P lacked a cause of action under Bivens. P appealed. The Fourth Circuit reversed, concluding that P could proceed with his Eighth Amendment excessive-force claim for damages as no “special factors counseled against extending Bivens” here. The Fourth Circuit denied rehearing en banc. Ds appealed.
