In 1959, Fairbrother conveyed a parcel of land to Adams. The warranty deed contained provisions concerning water rights, woodcutting rights, and hunting and fishing rights. The trial court held that the deed in question lacked words of inheritance or assignability in the granting clause and as such the right conveyed were personal. This appeal resulted.
