Facts
Cleo and Rickie were married and had two children. Cleo was awarded custody of the two children when they were divorced. No child support was awarded, as Cleo had not made a request for it. Cleo and Rickie then entered into a written agreement for Rickie to pay $250 per month for child support. That agreement was never ratified by the court. The Child Advocate Office located Rickie in Florida late in 1981 through its efforts to collect child support. Rickie appeared and challenged the petition's claim that he was the father of Amber Dawn. Rickie requested a blood test, but the court ordered temporary support. At a second hearing, the court ruled that Rickie was the father of Amber and entered an order to pay child support and arrearages. An amended divorce order was then issued in West Virginia stating that Rickie was not the natural father of Amber. The CAO appealed that decision.
