Facts
D installed a replacement hot water heater in P's home. D told P that he believed the old unit was under warranty, and that he would try to obtain a credit against the cost of the new water heater from the manufacturer. D returned the defective unit to a supplier. D has not given P the desired credit and claims that he has failed to do so because he has not received payment from the manufacturer. P sued D in small claims court for the replacement value of the water heater and assorted costs. The district court rendered judgment in favor of P. D appealed.
