Facts

The will of a brother left $75,000 in trust to invest and pay the net income to his brother Charles for life. The payments were to be made free from the interference or control of his creditors and that the use of the said income shall not be anticipated by assignment. The issue before the court was whether the trust could be used to pay the debts of the brother.
