Facts

Ronald (H) and Noleen (W) filed for divorce after a 37-year marriage. W and H executed a property settlement agreement, and the district court merged the agreement into the divorce decree. Eight months later W filed a motion to compel enforcement of the decree. H had just turned 65, refused to apply for social security benefits, and refused to deposit 1/2 of those benefits into W's bank account. H opposed W's motion in that federal law prohibited the division of social security benefits and that the agreement did not require him to apply for social security benefits at a certain age. The district court granted W's motion. H appealed.
