Latin. An agreement to make a gift. Such an agreement confers upon the donee no right in the subject agreed to be given, as the donor continues proprietor until delivery. The donor may, therefore, even gratuitously, give and deliver it to another, who thereupon becomes proprietor. This paction confers upon the first donee a jus ad rem, in respect of which he may sue the donor for performance, or damages for breach of agreement, if performance be refused or be rendered impossible by the act of the donor.
