By the Act 1597, cap. 250, it was made a statutory condition of all feus, that if the feu-duty remained unpaid for two whole years together, the vassal should forfeit his right to the lands, in the same manner as if an irritant clause to that effect was engrossed in his infeftment. This being a penal irritancy, requires to be declared by an action, which is still competent to a superior, and is called an action of tinsel of the feu.
