Earth movement includes such events as earthquakes, volcanic eruptions, landslides, subsidence, mud flows, sink holes, erosion, sinking, shifting, and settling. See, e.g., Murray v. State Farm Fire & Cas. Co., 203 W. Va. 477, 509 S.E.2d 1, 8 (W. Va. 1998). 'A small majority of jurisdictions hold that [such] exclusions do not apply to earth movements that are non-natural in origin or source.' Fayad v. Clarendon Nat'l Ins. Co., 899 So. 2d 1082, 1086-89 (Fla. 2005); Murray, 509 S.E.2d at 4-5, 10; Peach State Uniform Serv., Inc. v. Am. Ins. Co., 507 F.2d 996, 1000 (5th Cir. 1975) (applying Georgia law).
