Facts

Wells commenced this action by petitioning the probate court to settle its accounts and to approve its resignation as cotrustee. The Boltwoods filed an objection to the accounts and petitioned to remove Rosa as cotrustee and for surcharge and damages. During the litigation, the Boltwoods requested that Wells provide documents related to the trust. They produced documents which showed confidential communications with their attorneys, but they refused to provide those documents or disclose the contents of the communications. Boltwood claimed misconduct and moved to compel production. Wells claimed attorney client privilege. The superior court ruled for Boltwood.
