Facts

Rezaq (D) was part of a terrorist group that high jacked an airplane in Athens, shot a number of passengers and killed two of them. D was tried and convicted in Malta and served seven years in prison and was released. D was then taken into custody in Nigeria and brought to the U.S. for trial. D defended the action on grounds of insanity and obedience to military orders. D was found guilty and appealed. D contends that the international treat regarding air piracy prevents sequential prosecutions for the same offense and therefore it was illegal for the U.S. to try him after he had been tried and convicted in Malta.
