United States v. Fuji No.

00CR17, Sept. 25, 2000 609 WL 33357453 (2000)

Facts

D sought admission to the United States at O'Hare Airport. D presented what turned out to be a counterfeit Japanese passport. When D was stopped at the airport, INS officials also found three Chinese women trying to destroy their Japanese passports in the airport's public restroom. The Chinese nationals sought political asylum. P proposes to call Ms. Cox to identify D as the writer of certain handprinted immigration forms submitted at John F. Kennedy International Airport in New York in December 1999 in connection with the attempted fraudulent entry of two different Chinese nationals. The court had ruled that the December 1999 smuggling evidence, if otherwise admissible, can be offered under Rule 404(b). The court held a Daubert hearing.
