The trustee brought suit for declaratory judgment to interpret a trust created by Rinehart who died in 1932. The trust provided that certain payments were to be made to the testator's daughter who was age 13 at his death and until she reached the age of 25. From 25-32, all the trust income was to be paid to the daughter, and when she reached 32, the trust estate was to be distributed to the daughter provided that she has proved to the trustee that she has not embraced the Catholic faith nor was she married to a man of such faith. The daughter when she reached the age of 32 in 1951, had married a member of the Catholic faith. The lower court held the provisions of the will valid and decreed the forfeiture of the daughter's interest in the trust estate. This appeal followed.
