Three Juveniles v. Commonwealt

390 Mass. 357, 455 N.E.2d 1203 (1983)

Facts

A grand jury investigated the possible murder of a missing woman by the children's father. It tried to get testimony from the children (P) about this incident. Both P and the parent objected. Subpoenas were issued to try to get this testimony. P moved to quash the subpoena, claiming a family or parent-child privilege not to testify. The motion was denied. P filed a petition seeking a reversal of the denial of their motion.
