Facts

Several women claimed that the saw Peery (D), a student who lived in a college dormitory, standing in front of or near his window exposed to view and entirely unclothed. D was an army veteran, and a professor testified that he was a man of good reputation and high standing in his class. There was no evidence that D tried to attract the attention of the witnesses who saw him naked. D testified that he had not intentionally exposed himself. D was convicted of indecent exposure. D appealed.
