State v. Mai

287 A.2d 715, 60 N.J. 203 (1972)

Facts

Maik (D) was a college student. He took hallucinogens, which he claimed led to a psychotic episode. During this episode, he violently killed another student. D was convicted of second-degree murder. D appealed, claiming that the court instructions were wrong. The court had instructed the jury that voluntary intoxication could not negate a second-degree murder charge.
