Davis (D) and Hinds had an argument. Hinds hit D with little or no provocation. Hinds went to get a gun, stating that he thought that D was going to try to shoot him. D went home and got his shotgun because he was scared. D then approached a store through a cornfield in order that Hinds would not see him. While in the cornfield, D saw Hinds approach and ducked down in order not to be seen. Hinds spotted him and aimed his rifle, and D shot in self-defense. Hinds was killed. D was charged with murder. D was found guilty and appealed.
