Simmons v. Simmon

409 N.E.2d 321 (1980)

Facts

H and W were married for 16 years. H was 55 and W was 49, and they have no children. The dissolution of the marriage was entered and 11 months later the court entered supplement to judgment. This was a dispute over the fact that W had a good job and was able to support herself and really didn't need maintenance from H but the court kept awarding W maintenance. W wanted H to accommodate her personal tastes for such things as eating out and the trial court awarded W $530 per month. H appealed.
